TERMS OF SERVICE: For Creators
1. This is a public Web site intended for the dissemination of creative works. It is not to be used like flickr, facebook or myspace, nor is it to be used by corporations or for business purposes. It abides by the PAVED Arts Membership Policy in terms of what can and cannot be uploaded on the site. PAVED Arts is a government-subsidized artist-run centre and as such the PAVED Arts community website is intended for personal artistic and creative expression, not for commercial enterprise.

2. You own your own material. PAVED Arts claims no intellectual property rights over the material you provide to our service. When or if you use somebody else’s photo or name or song, it is your responsibility to have written consent and approval/agreement.

3. You must be at least 16 years old to upload material to this site without the supervision of a parent, guardian, instructor or mentor/guidance counselor.

4. You must be a member of PAVED Arts to upload material to the site.

5. Your personal information will not be displayed on the site (unless you choose to). We will not give your name or contact information to any outside party — ever — unless we are required to do so by law.

6. You are responsible for making sure that we have the most up-to-date contact information. If we do not, you will not receive pertinent website updates and changes.

7. We are not liable if someone uses your work. We will make every effort to protect you, the artist, but in any instance where video is streamed or images appear on a publicly accessible website, we cannot promise that it is entirely safe. You’re free to pursue legal remedies against such a third party, but you agree not to seek legal redress against PAVED Arts, AKA Gallery or 20 Above Holdings.

8. By agreeing to place your material on our site, you recognize that it may also appear on search engines.

9. You affirm that you own the rights to the material you are placing on the PAVED Arts site, have obtained the proper clearances to do so, or have the right to share it under well-accepted fair use standards.

10. You agree that the work you upload does not violate copyright, trademark or patent laws, is not pornographic, plagiaristic or defamatory, is not hate speech or spam, and does not violate anyone’s privacy rights. We reserve the right to remove material that we determine in our sole discretion violates these rules. We also reserve the right to terminate the membership of anyone who violates these rules.

11. We will not edit or alter your work. However, you agree to allow PAVED Arts staff and members to add tags to your works (such as your name, the themes, etc.). Tags may also be removed if they offend the PAVED Arts community or if they intentionally mislead readers.

12. You may at any time withdraw material from this site that you previously agreed to share.

TERMS OF SERVICE: For the Audience
1. When using the PAVED Arts Members Driven Website, you must not violate any laws in your jurisdiction (including but not limited to copyright laws).

2. Because this site contains contributions from individuals, groups and cultures with different standards and mores, PAVED Arts errs on the side of inclusion. The site may contain material deemed offensive, disturbing, pornographic, racist, sexist, bizarre, misleading, fraudulent, or otherwise objectionable. PAVED Arts does not endorse any content uploaded to our site, nor can we guarantee that the material is accurate, complete, noninfringing or legally accessible in your jurisdiction. We will remove content that we deem in violation of these terms of use, but we have no obligation to remove content deemed inappropriate by an outside individual or group unless it can be demonstrated to be illegal. PAVED Arts staff will be the sole arbiters of whether material shall be removed from this site. However, if you see material that violates these terms of use or may be illegal, please contact us.

3. You understand that the main purpose of the PAVED Arts Community Website is for the advancement of public education, the furthering of free public access to cultural materials and the dissemination of new media work by our members. The views expressed by our members are those of our members and not of PAVED Arts, AKA Gallery, or 20 Above Holdings.

Consent to these provisions
The PAVED Arts membership policy and these terms of service govern all use of this site. Both Artists and Audience agree to these terms by their use of the site. Violation of any of these terms may result in the termination of your use of the PAVED Arts Members Driven Website.

Copyright Policy
PAVED Arts Members Driven Website obeys all Canadian copyright laws. We will remove material from our site when we receive proper notice of alleged infringement that meets the requirements of federal law. Because this site allows individuals to upload materials without curator approval, some copyrighted material will inevitably find its way to our servers. PAVED cannot be responsible for the content posted by users on this site and in our network, but we will make a good faith effort to remove any such material as promptly as possible after proper notification.

Upon notification to PAVED Arts of a claimed copyright infringement, we will attempt immediately to remove the material that is claimed to be infringing or to be the subject of infringing activity pursuant to the following terms and conditions:

Any person who knowingly materially misrepresents that material or an activity is infringing or that material or activity was removed or disabled by mistake or misidentification, shall be liable to PAVED Arts for any damages, including costs and attorneys’ fee, incurred by PAVED Arts in removing or disabling access to the material or activity claimed to be infringing, or in replacing the removed material or ceasing to disable access to it.

PAVED Arts is under no circumstances responsible for any indirect, incidental, special, or consequential damages arising from or in connection with the use of or the inability to use the site, or any content contained on the site, or resulting from unauthorized access to the site, including, without limitation, damages for loss of profits, use, data or other intangibles, even if PAVED Arts has been advised of the possibility of such damages.

Changes and Full Agreement
We expect to modify these Terms of Use as time goes on, and you understand and accept that fact.
